These terms constitute a legally binding agreement. By booking a session you confirm you have read and agree to these terms in full.

1. Services

My New Dawn Hypnotherapy ("we," "us," "Dawn") provides private hypnotherapy sessions delivered via secure video conference. The core service is The Dawn State — a 90-minute one-on-one hypnotherapy session conducted through Whereby at whereby.com/mynewdawn.

Optional add-ons include session audio recording and personalized hypnosis audio, subject to availability and current promotional terms.

2. Not a Medical or Mental Health Service

Hypnotherapy is a complementary wellness service. It is not a substitute for medical treatment, psychotherapy, psychiatric care, or any licensed mental health service. Dawn is a certified hypnotherapist, not a licensed physician, psychologist, or therapist.

By booking, you confirm that you are not seeking and will not use hypnotherapy as a replacement for professional medical or psychological care. If you are currently under the care of a medical or mental health professional, you agree to inform them of your intent to pursue hypnotherapy.

3. Eligibility

You must be 18 years of age or older to book a session.
Sessions are not appropriate for individuals with psychosis, schizophrenia, epilepsy, or certain other conditions. You represent that none of these conditions apply to you.
You must have a stable internet connection, a device with camera and microphone, and a private, quiet space for your session.

4. Payment

Payment is collected at the time of booking through Calendly's secure checkout, powered by Stripe. All prices are listed in US dollars. Payment is required in full before your session is confirmed.

By providing payment information, you authorize us to charge the total amount selected at checkout, including any optional add-ons chosen during booking.

5. Cancellation and Rescheduling

You may reschedule your session up to 24 hours before your scheduled start time at no charge using the reschedule link provided in your confirmation email.

Cancellations made more than 24 hours before the session will receive a full credit toward a future session. Cancellations made within 24 hours of the session are non-refundable. No-shows are non-refundable.

We reserve the right to cancel or reschedule sessions due to illness, emergency, or technical failure. In such cases you will receive a full refund or priority rebooking at your preference.

6. Session Recording

Sessions are not recorded by default. If you have selected the Session Audio Recording add-on, your session audio will be recorded, processed, and delivered to your provided email address within 48 hours of your session. By selecting this add-on you consent to being recorded.

You may not record any session yourself without prior written consent from Dawn.

7. Personalized Hypnosis Audio

If you have selected the Personalized Hypnosis Audio add-on, a custom audio file will be created based on your session content and delivered within 48 hours. This audio is for your personal use only and may not be shared, redistributed, or used commercially.

8. Informed Consent for Hypnotherapy

By booking a session, you acknowledge that:

Hypnotherapy involves entering a focused, relaxed state of awareness. You remain conscious and in control at all times.
Results are not guaranteed. Individual outcomes vary.
You are participating voluntarily and may end the session at any time.
You will complete the pre-session intake form honestly and fully before your session.

9. Limitation of Liability

To the maximum extent permitted by law, My New Dawn Hypnotherapy shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount paid for your session.

10. Intellectual Property

All content on mynewdawn.life — including text, design, scripts, techniques, and audio materials — is the intellectual property of My New Dawn Hypnotherapy. You may not reproduce, distribute, or create derivative works without written permission.

11. Governing Law

These terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Orange County, California.

12. Changes to Terms

We may update these terms at any time. Continued use of our services constitutes acceptance of the updated terms. The effective date at the top of this document reflects the most recent revision.

Name and email address (collected at booking via Calendly)
Payment information (processed by Stripe — we never see or store your card details)
Pre-session intake form responses (health background, goals, personal history)
Session content if you have selected the audio recording add-on

Basic usage data (pages visited, time on site) via standard server logs
Device and browser type for technical compatibility

3. How We Use Your Information

To confirm and manage your booking
To prepare and deliver your session
To send session confirmations, reminders, and follow-up communications
To deliver audio recordings or personalized audio files
To comply with applicable legal obligations

We do not use your information for advertising. We do not sell your data. Ever.

4. Third-Party Services

We use the following trusted services to operate our practice:

Resend — transactional email delivery

Each service operates under its own privacy policy and security standards. We select partners who maintain strong data protection practices.

5. Sensitive Health Information

Your intake form may contain sensitive personal and health-related information. This information is used solely to prepare your session. It is stored securely, never shared with third parties, and handled with the highest level of confidentiality.

6. Data Retention

Booking and payment records are retained for 7 years as required by applicable tax and business regulations. Intake form responses and session notes are retained for 3 years and then securely deleted. You may request earlier deletion by contacting us.

7. Your Rights (California Residents — CCPA)

If you are a California resident, you have the right to:

Know what personal information we collect and how it is used
Request deletion of your personal information
Opt out of the sale of your personal information (we do not sell data)
Non-discrimination for exercising your privacy rights

8. International Users

We serve clients globally, including across North and South America. If you are located outside the United States, your information may be transferred to and processed in the United States. By using our services, you consent to this transfer.

9. Security

All data is transmitted over encrypted connections (SSL/TLS). Payment data is handled entirely by Stripe and is never stored on our servers. Session video is conducted through Whereby's end-to-end encrypted platform.

10. Cookies

Our website uses minimal cookies necessary for functionality. We do not use tracking or advertising cookies. Third-party services (Calendly, Stripe) may set their own cookies when you interact with their embedded tools, subject to their respective privacy policies.

11. Children's Privacy

Our services are intended for adults aged 18 and older. We do not knowingly collect information from minors. If you believe a minor has provided us with personal information, please contact us immediately.

12. Changes to This Policy

We may update this policy periodically. We will notify you of material changes via email or a notice on our website. The effective date reflects the most recent update.
